Promise To Pay:

1. At Freedom Rider the payment of all rental cost and all other fees becomes the obligation of the Customer at the time of renting. This agreement is between the Customer and Freedom Rider. Freedom Rider asks the Customer to carefully read the following disclosures, terms, and conditions.
2. All rental fees are due at time of booking, prior to delivery. Any requested services that incur a fee during the rental are due upon request. Any additional fees incurred are due immediately upon the completion of the rental. Customer agrees to allow Freedom Rider to process all charges due to the credit card used at the time of booking. If for any reason the credit card payment does not go through, the Customer agrees to pay Freedom Rider any balances due within 30 days from the completion of the rental.
3. Administrative, clerical, or technical billing errors do not absolve the Customer of financial responsibility to pay the correct amount of rental cost, fees and other associated financial obligations assessed because of the rental agreement with Freedom Rider. If a payment made to a Freedom Rider is returned by the bank for any reason, the Customer will repay the original amount of the payment due plus a returned payment fee of $40, as allowed by law.
4. When an account becomes past due, Freedom Rider has the right to take actions to collect the balance which includes but is not limited to reporting the Customers balance to credit reporting agencies and taking legal action to collect the balance due. The Customer authorizes Freedom Rider, and those concerned with collecting the balance owed, to use all telephone numbers provided by the Customer. This includes cell phones and the use of auto-dialers to contact the Customer.
5. The Customer authorizes Freedom Rider to release financial information about his/her account to those concerned with collecting the balance owed. In the event Freedom Rider incurs any expenses in collecting on the Customer’s account, the Customer agrees to pay Freedom Rider ‘s cost of collection. This includes, but is not limited to, a collection agency fee and/or reasonable attorney’s fees, depending on the actions necessary to collect the debt.

Rental Term:

1. The rental term commences on the scheduled pickup date and ends upon the date when the equipment is returned to Freedom Rider in accordance with this Agreement.
2. Freedom Rider shall have the right to immediately retake and repossess the equipment and terminate this agreement if the Customer fails to comply with any of the terms and covenants, conditions, and understandings herein. The Customer waives all claims to damages or expenses in respect of such seizure and repossession.

Loss and Damage:

1. The Customer acknowledges that within thirty (30) minutes of receipt of equipment that they have fully inspected and accepted the equipment in good condition and repair. If there is a concern or issue the Customer, or their Representative will contact Freedom Rider within thirty (30) minutes. Failure to notify Freedom Rider will confirm acceptance of the rental equipment.
2. The Customer further acknowledges that the Operator of rental equipment is familiar and knowledgeable with the operation, care and control of the equipment and is capable of safely operating the equipment.
3. Customer agrees that they were provided the opportunity to select or decline Equipment Protection Plan (EPP) for the rental agreement. If they chose to decline the EPP they are responsible for all repair and/or replacement costs on the rental equipment.
4. The Customer, or their Representative, will return the Equipment at the end of the term in the same condition as received.
5. The Customer agrees to pay all costs, expenses, and legal fees incurred by Freedom Rider in regaining possession of the Equipment or in enforcing or recovering any damage, losses or claims against the Customer.

Waiver of Liability:

The Customer acknowledges that operating the Equipment has inherent risks, dangers, and hazards, including, but not limited to, traffic conditions, weather conditions, road and sidewalk conditions, natural and unnatural objects and obstacles, impact or collision, and negligence of others. THE CUSTOMER ASSUMES ALL RISK AND LIABILITY FOR ANY AND ALL LOSS, DAMAGE, OR INJURY, INCLUDE DEATH TO PERSONS OR PROPERTY OF THE CUSTOMER. This to include any other damages or loss arising out to the rental possession, use, operation or care and control of the equipment by the Customer, and their representative including, but not limited to, all medical cost, financial and economic losses.

Release:

The Customer waives, releases and forever discharges Freedom Rider, it’s directors, officers, shareholders, employees, affiliate, agents, servants, heirs, executors, administrators, legal representatives and assigns from all manner of actions, causes of actions, costs, expenses, liability, claims and demands for or by reason of any damage, loss, or injury to person and property which has been or may be sustained related to the rental, possession, use, operation or care and control of the Equipment. The Customer acknowledges that this release is given with the express intention of effecting the extinguishment of certain obligations owed to the Customer and with the intention of bind the Reenter’s spouse, heirs, executors, administrators, legal representative and assigns.

Indemnity:

The Customer shall defend, indemnify and hold harmless Freedom Rider , all of its directors, officers, shareholders, employees, affiliates, agents, servants, heirs, executors, administrators, legal representative and assigns from and against any and all losses, liability claims, damages, costs, expenses, attorney fees, injuries, demands, actions and causes of action, arising out of or related to directly or indirectly any loss, damage or injury claimed by any persons that may arise from the Customer’s rental, possession, use, operation or care and control of the Equipment.

Governing Law:

It is the intention of Freedom Rider and the Customer that this Agreement and the performance under the Agreement, and all suits and proceedings under this Agreement, be construed in accordance with and governed, to the exclusion of the law of any other forum, by the laws of the State of Florida without regard to the jurisdiction in which any action or proceeding may be instituted. The parties hereto attorn to the non-exclusive jurisdiction of the courts of the State of Florida.

Severability:

If any part of this Agreement be declared or held invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect the validity and enforceability of the remainder, which shall continue in force and effect and be construed as if this Agreement had been executed without the invalid or unenforceable portion and it is hereby declared the intention of the parties hereto that this Agreement would have been executed without reference to any portion which may, for any reason, be hereafter declared or held invalid or unenforceable.

Exclusion of Anti-Social Forces:

The Customer represents and warrants that they do not fall under any of the following categories: (a) the anti-social forces (defined as [1] an organized crime group, a member of an organized crime group, a related company or association of an organized crime group, and any other equivalent person above; or [2] a person who themselves or through the use of third parties conducts a demand with violence, an unreasonable demand beyond its legal entitlement, use of intimidating words or actions, damages the credit or obstructs the business of the other party by spreading false rumors or by the use of fraudulent means, or any other equivalent actions above); (b) a person having such relationship with the anti-social forces that shows the anti-social forces’ substantial involvement in the person’s management; (c) a person having such relationship with the anti-social forces that shows reliance on the anti-social forces; (d) a person who cooperates and is involved with the maintenance or operation of any anti-social forces by providing funding to anti-social forces or any similar act; (e) a person who is engaged in socially condemnable relationships with the anti-social forces.

Entire Agreement:

This Agreement, ten (10) pages constitutes the entire agreement between Freedom Rider and the Customer. This Agreement shall not be amended, altered, or changed except by a written agreement signed by Freedom Rider.
